City of Hamilton has advised that solicitors can act on behalf of a seller to cancel a pre-authorized tax payment on behalf of a client. The solicitor must use the City’s form of notice and the notice must be received at least 2 weeks before the date the cancellation is scheduled to occur. The City cannot stop a pre-authorized payment that is scheduled to be withdrawn within 2 weeks of a payment date, so that needs to be factored into the request for cancellation and an appropriate adjustment as between vendor and purchaser on the statement of adjustments would still be required.
